1. Acceptance of these terms
By downloading, accessing, or using Promise, you agree to these Terms of Use. If you do not agree, do not use the app or website. Apple’s applicable App Store terms also apply to your download and use of the app.
2. The Promise service
Promise lets you create alarms, record personal voice messages, select repeat days and snooze options, and optionally use a wake-up confirmation. Features may vary by device, operating system, permissions, and app version.
You are responsible for maintaining a compatible device, granting required permissions, keeping sufficient battery charge and volume settings, and testing alarms before relying on them.
3. Important alarm reliability notice
Mobile alarms can be affected by device power, volume and focus settings, permissions, operating system behavior, hardware problems, software errors, or changes outside our control. We do not guarantee that any alarm, notification, recording, snooze, or wake-up check will occur at a particular time or without interruption. Use a backup alarm whenever missing an alarm could cause harm or significant loss.
4. Your recordings and content
You retain ownership of the voice recordings, promise titles, and other content you create. You give Promise permission to process that content locally on your device only as needed to provide the features you request, such as preparing a recording for use as an alarm sound.
You are responsible for ensuring you have the right to record and use any content you place in Promise. Do not record another person without any consent required by applicable law.
5. Acceptable use
You agree not to misuse Promise, attempt to defeat security controls, reverse engineer the app except where applicable law expressly permits it, interfere with the service, or use it in violation of law or the rights of others.
6. Our intellectual property
Promise, including its software, interface, visual design, name, logo, and original content, is owned by Islam Alsaadawy or its licensors and is protected by applicable intellectual property laws. These terms give you a limited, personal, non-exclusive, non-transferable, revocable right to use the app for its intended purpose.
7. Changes and availability
We may update, change, suspend, or discontinue features. Updates may be required for the app to continue working with your operating system. We may also revise these terms by posting an updated version with a new effective date.
8. Disclaimers
To the fullest extent permitted by law, Promise is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. Nothing in these terms excludes warranties that cannot legally be excluded.
9. Limitation of liability
To the fullest extent permitted by law, Islam Alsaadawy will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, opportunities, or goodwill, arising from or related to Promise—including a missed or delayed alarm. Where liability cannot be excluded, it will be limited to the greater of the amount you paid for Promise in the 12 months before the claim or US$10.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Apple-specific terms
These terms are between you and us, not Apple. Apple is not responsible for Promise or its support. To the extent any warranty applies and Promise fails to conform, you may notify Apple for any refund available under App Store rules. Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.
11. General
If any provision is unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not transfer these terms without our consent. These terms, together with our Privacy Policy, are the entire agreement concerning Promise.
